1. Acceptance of these terms
This website at icebergev.ca is operated by 94701 Newfoundland & Labrador Ltd., carrying on business as Iceberg EV ("Iceberg EV", "we", "us", "our"). By accessing or using this site you agree to these Terms of Use. If you do not agree, please do not use the site.
2. What these terms cover — and what they don't
These terms govern the website only. Your participation in the Iceberg EV charging network — your rebate rate, term, termination rights, data and environmental attribute assignment, and everything else about the commercial relationship — is governed exclusively by the Charging Network Hosting Agreement you sign.
If anything on this website conflicts with that agreement, the agreement prevails. Nothing on this site varies, supplements or waives any provision of it.
This website is informational. Browsing it does not create a contract between us, does not enrol you in the network, and does not entitle you to any payment. You become a host only when a hosting agreement is executed by both parties.
3. Eligibility
The Iceberg EV network is available only to residents and businesses in Newfoundland and Labrador, Canada, at properties they own or otherwise have the right to install equipment on. We may decline any application at our discretion, including where a site is outside our service area, is technically unsuitable, or cannot be safely or lawfully served.
You must be at least the age of majority in your province to enter into a hosting agreement.
4. Information on this site
We work to keep this site accurate and current, but information here is provided for general information only. Rates, program details, equipment compatibility, availability and third-party incentive programs can change, and external programs referenced on this site are administered by others and may be modified, suspended or closed without notice to us.
Nothing on this site is financial, tax, legal or electrical advice. Payments you receive as a host may be taxable; consult your own advisor about your situation. Any installation must be carried out by a licensed electrician and comply with the Canadian Electrical Code and all applicable permits and inspections — we do not perform, supervise or certify electrical work.
5. Rebate figures are estimates, not guarantees
Any rebate or savings figures shown on this site are illustrative estimates based on stated assumptions about annual energy use, electricity prices and driving distance. They are not a promise, projection or guarantee of what you will receive.
What you actually receive depends on how much energy your charger delivers, whether it is connected to the network at the time, your electricity rate, and the terms of your hosting agreement — including the minimum rebate threshold and the fact that energy delivered while the charger is offline and not recovered from charger memory is not rebated. Comparisons to other programs reflect publicly available information at the time of writing and may become out of date.
6. Setup guides and technical instructions
The setup guides on this site are provided to help you connect equipment you own to our network. They assume the charger has already been mounted and wired by a licensed electrician, and that the amperage was set correctly at installation.
You are responsible for following the manufacturer's instructions for your equipment and for the safety of your installation. Do not attempt any step that requires opening the unit, altering wiring, or working on your electrical panel — that is work for a licensed electrician. If a guide conflicts with the manufacturer's documentation, follow the manufacturer.
7. Acceptable use
You agree not to:
- use this site for any unlawful purpose or in violation of these terms;
- attempt to gain unauthorized access to the site, our network, our management systems, any dashboard other than your own, or any account, server or system connected to them;
- register, impersonate or report data from equipment you do not own or control, or submit false, fabricated or misleading registration or metering information;
- interfere with, disrupt, probe or test the vulnerability of the site or our systems, or circumvent any security or authentication measure;
- use automated means to scrape, harvest or copy content or contact information from the site; or
- introduce malware or any other harmful code.
Host dashboard links are personal to you. Please keep yours confidential and tell us promptly if you believe it has been shared or compromised.
8. Intellectual property
The content of this site — text, layout, graphics, photographs, logos, icons and code — is owned by Iceberg EV or its licensors and is protected by Canadian and international copyright and trademark law. The Iceberg EV name and logo are our trademarks.
You may view, download and print pages for your own personal, non-commercial use in evaluating or participating in the program. Any other reproduction, distribution, modification, republication or commercial use requires our prior written permission. Third-party names, marks and product images referenced on this site remain the property of their respective owners and are used for identification only.
9. Third-party sites and services
This site links to sites and services operated by others — including equipment manufacturers' stores and our e-signature provider. We do not control them, do not endorse their content, and are not responsible for their products, availability, pricing, practices or privacy policies. Purchases you make from a manufacturer or retailer are between you and them; any warranty, return or support obligation for equipment you buy is theirs, not ours.
10. Availability of the site
We do not guarantee that the site will be uninterrupted, timely, secure or error-free. We may change, suspend or discontinue any part of the site, and may restrict access, at any time and without notice.
11. Disclaimer
To the fullest extent permitted by law, this website and its content are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here excludes or limits any right you have under applicable consumer protection legislation that cannot lawfully be excluded or limited.
12. Limitation of liability
To the fullest extent permitted by law, Iceberg EV and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of — or inability to use — this website, whether based in contract, tort (including negligence), statute or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to your use of this website is limited to CAD $100.
This section limits liability arising from the website. Liability arising from your participation in the charging network is governed by the limitation of liability provisions of your hosting agreement, not by this section. Nothing in these terms limits liability for personal injury or death caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
13. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
14. Governing law
These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable in it, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts of Newfoundland and Labrador, except where applicable consumer protection law entitles you to bring proceedings in your own place of residence.
15. Changes to these terms
We may revise these terms from time to time. The effective date at the top of this page shows when they were last changed. Changes take effect when posted, and your continued use of the site after that means you accept them. If you do not agree to a change, please stop using the site.
If any provision of these terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions stay in full force.
